These Terms of Service (“Terms”) govern your use of the Appsium App Store Optimization portal at appsium.io and app.appsium.io (the “Service”). By creating an account or using the Service, you agree to these Terms. If you use the Service for a company, you accept them on its behalf.
1. Who we are
The Service is provided by Berkay Öçgüder, trading as Appsium, in Türkiye (“Appsium”, “we”, “us”). Contact: support@appsium.co.
2. Accounts
You must be at least 18 years old and able to enter a binding contract. Give accurate information, keep your sign-in details safe and tell us promptly about any unauthorized use. You are responsible for activity under your account. One free account per person; creating extra accounts to collect free credits is not allowed.
3. Connecting Apple services
When you connect an App Store Connect API key or Apple Ads credentials, you confirm that you are authorized to do so and you instruct us to access those services on your behalf for the actions you request. You stay responsible for the content you approve and send to Apple, for compliance with Apple's Developer Program License Agreement, App Review Guidelines and other Apple terms, and for the roles and permissions of the keys you provide. You can disconnect a key at any time.
Appsium is an independent product and is not affiliated with, endorsed or sponsored by Apple Inc. App Store, App Store Connect and Apple Ads are trademarks of Apple Inc.
4. Plans, credits and payments
- Plans. The Free, Pro and Studio plans, their limits and prices are shown on our pricing section and in the portal. Prices are in US dollars and may exclude taxes, which are added at checkout where applicable.
- Credits. AI actions consume credits from a single balance at the rates shown in the portal before you run them. Credits have no cash value, cannot be transferred or exchanged, and are not refundable except where the law requires. Credits for actions that fail are returned automatically.
- Monthly credits included in a paid plan refresh each billing month and do not roll over. Yearly plans receive their credits month by month.
- Free sign-up credits and credit packs do not expire while your account is active. Monthly plan credits are used before them. Credit packs are available to paid plans.
- Subscriptions renew automatically at the end of each billing period until cancelled. You can cancel at any time; your plan stays active until the end of the period you paid for.
- Payments are processed by our payment provider, which may act as merchant of record and its own terms will then also apply. Refunds follow that provider's process and applicable consumer law.
- Changes. We may change prices, credit rates or plan limits. Price changes for an existing subscription take effect at your next renewal after we give you notice.
5. Acceptable use
Do not use the Service to:
- break the law, infringe others' rights or upload content you have no right to use;
- create misleading store listings, impersonate other apps or brands, or produce spam or manipulative reviews;
- access accounts, keys or apps you are not authorized to use;
- probe, overload, scrape, resell or reverse engineer the Service, or bypass its limits, credit metering or security;
- use the Service or its output to build a competing product.
We may apply rate limits and may suspend or restrict use that breaches these Terms or threatens the Service or other users.
6. Your content and AI output
You keep all rights to the content you add. You give us a limited licence to host, process and transmit it — including to our AI and infrastructure providers — only to provide the Service to you. Subject to these Terms and applicable law, you may use the output generated for you. AI output can be inaccurate, similar to content produced for others or unsuitable for your market; review it, and make sure it is accurate and that you have the rights you need before you publish it.
7. Our intellectual property
The Service, its software, design and brand belong to Appsium and its licensors. These Terms give you a personal, non-exclusive, non-transferable right to use the Service while your account is active; no other rights are granted.
8. No guarantee of results
Search rankings, conversion and App Review decisions are controlled by Apple and the market. Scores, popularity estimates, simulations and pre-review checks are guidance, not promises. We do not guarantee any ranking, download, revenue or approval outcome.
9. Availability and changes
We work to keep the Service available and secure, but it is provided “as is” and “as available”. It depends on third parties such as Apple, Google and our AI providers, whose availability we do not control. We may add, change or remove features; if a change materially reduces a paid plan you have already paid for, we will offer a fair remedy as required by law.
10. Limitation of liability
To the extent permitted by law, Appsium is not liable for indirect or consequential losses, lost profits, lost data or business interruption, and our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim (or USD 50 if you have not paid anything). Nothing in these Terms limits liability that cannot be limited by law, including for intentional misconduct or gross negligence, or your mandatory consumer rights.
11. Suspension and termination
You can stop using the Service and ask us to delete your account at any time. We may suspend or close accounts that seriously or repeatedly breach these Terms, put others at risk, or where required by law; where reasonable we will warn you first. Unused credits are forfeited on termination for breach. Sections that by their nature should survive termination will survive.
12. Privacy
Our Privacy Policy explains how we handle personal data.
13. Changes and governing law
We may update these Terms. We will change the date at the top of this page and, for material changes, notify you by email or in the portal before they take effect; continuing to use the Service after that means you accept the new Terms. These Terms are governed by the laws of Türkiye, subject to any mandatory consumer protection rules of the country where you live.
